Terms of use
1. Purpose
PinMatches is a service published by Cyxxon Inc. that brings together people who want to play a sport together: anyone can create a geolocated match, join nearby matches and talk to the other participants in a chat that belongs to each match.
Creating an account and using the app constitutes unreserved acceptance of these terms. Acceptance is asked for explicitly on first login; it can be withdrawn at any time from the profile, which ends access to the service.
2. Adults only
The service is restricted to people aged 18 or over. By creating an account, you declare that you are 18 or older. Any account that appears to have been created by a minor is closed and its data deleted.
3. Account
- Creating an account requires a username and a password. The username must be available and must not impersonate a third party, nor be abusive, misleading or unlawful.
- You are responsible for keeping your password confidential and for all activity carried out from your account. The password must be 8 to 128 characters long and contain at least one letter and one digit.
- The username you choose is visible to all users in the players list of the matches you take part in.
- You can close your account at any time from the app (Profile → “Delete account”) or from the Account deletion page.
4. What the service does — and does not do
PinMatches is limited to putting users in touch with one another. Cyxxon Inc. does not organise the matches, does not supervise them, provides neither equipment nor sports facilities, acts as no kind of referee and takes part in no transaction between users.
Users' identities are not verified. The service carries out no background checks. The information published in a match (place, time, number of players) is declared by its author and is not verified.
5. Safety when meeting up
A match organised through PinMatches leads to a physical meeting with people you do not know. You take part in it under your sole responsibility. A few basic precautions:
- favour public, busy places;
- do not create a match at your home if you do not wish to disclose its address;
- make sure your state of health is compatible with the activity;
- check that you are covered by public liability insurance;
- end any meeting in which you do not feel safe.
Cyxxon Inc. is not a party to those meetings and cannot be held liable for what happens there, in particular injuries, damage to property or disputes between participants.
6. Expected conduct
The following, in particular, is prohibited:
- publishing messages or content that is offensive, unlawful, discriminatory, hateful, violent, sexual, defamatory or that constitutes harassment;
- publishing personal data about a third party without their consent;
- using the service for advertising, commercial or canvassing purposes, or sending spam through it;
- creating fake matches, creating multiple accounts or impersonating someone else;
- attempting to access data or conversations you are not entitled to, or disrupting the operation of the service;
- automatically extracting or reusing the content of the service.
7. Reporting, blocking and moderation
Any message you receive can be reported from the conversation, and its author blocked — from the conversation or from the list of a match's participants. These mechanisms are described in detail on the Community guidelines page.
Reports are reviewed. In the event of a breach of these terms, the content concerned may be removed and its author's account suspended or deleted without notice, depending on the seriousness of the facts. Manifestly illegal content may be passed on to the competent authorities.
Chat messages are kept for 12 months at most, except where they are the subject of a report or of a request from a competent authority; after that period they are deleted or anonymised.
8. Content you publish
You remain responsible for the content you publish (messages, match titles and details). You grant Cyxxon Inc. the non-exclusive, royalty-free right to host, reproduce and display it for the sole purpose of operating the service, for as long as it is retained. It is put to no other use, and it is not transferred to third parties.
9. Advertising
The service is free and funded by advertising, provided by Google AdMob. Ads are identified as such. The choice regarding personalised advertising is asked for on first launch and can be changed at any time (Profile → “Manage my ad choices”). See the privacy policy, section 6.
10. Availability of the service
The service is provided “as is”, with no guarantee of continuous availability or of freedom from error. It may be interrupted for maintenance, for further development or for security reasons. An update of the app may be made mandatory in order to keep using it, in particular where an earlier version is no longer compatible with the service.
Cyxxon Inc. may change the features, or suspend or discontinue all or part of them. In the event of a permanent shutdown of the service, notice is given within a reasonable time.
11. Liability
Cyxxon Inc. is not responsible for the content published by users, for their behaviour, or for how the matches organised through the service unfold. It cannot be held liable for indirect damage resulting from the use of the service.
Nothing in these terms has the effect of setting aside the rights granted to consumers by law, in particular the legal warranties provided for in sections 34 and following of the Consumer Protection Act and liability for bodily injury or gross fault.
12. Personal data
The processing of your data is described in the privacy policy, which forms an integral part of these terms.
13. Intellectual property
The app, the website, their visual identity and the PinMatches trade mark belong to Cyxxon Inc. No reproduction is permitted without prior written consent. The map backgrounds come from OpenStreetMap and are made available by its contributors under the Open Database License (ODbL).
14. Changes to the terms
These terms may be amended. Any change is published on this page, with a new version and a new effective date. It only applies to you once expressly accepted in the app, where it is presented to you at your next login; until then, the version you accepted remains applicable.
You may refuse a change: access to the service then ends, without cost or penalty, and the deletion of your account can be requested from the account deletion page.
15. Language
These terms are drawn up in French. This English version is a courtesy translation, made available at the user's request: by choosing this version, the user declares having expressly agreed to be bound by it. In the event of any discrepancy between the two versions, the French version prevails.
16. Governing law and disputes
These terms are governed by the laws applicable in the province of Québec and by the federal laws of Canada applicable therein. Any dispute falls within the jurisdiction of the courts of the judicial district of Longueuil, where Cyxxon Inc. has its head office.
In any event, consumers retain the right to bring proceedings before the court of their domicile or residence, in accordance with article 3149 of the Civil Code of Québec, as well as the benefit of the mandatory provisions of the Consumer Protection Act: no provision of these terms may deprive them of that right. These terms contain no arbitration clause and no class action waiver.
